When arrested for a DUI the police officer typically takes the physical license of the driver.  The form 1205 given by the police officer serves as a thirty day temporary permit.  This gives the charged the opportunity to request an adminstrative hearing.  It is common for clients not to act quickly and request a hearing within ten days.  This is a requirement for preserving your right to drive during the pendancy of your DUI charge.

Once the license is suspende because you did not request a hearing, it can be difficult to get any driving privileges until after the DUI charge is resolved.

Clients need to remember that they are responsible for protecting their rights.  A competent DUI attorney can get you through the process but you must be proactive.  Please call (678) 994-4091 if you have questions or e-mail me at dui@wkhesq.com.
